    What happens if your IU from the VA is back dated to a date that you were drawing state unemployment

    I stopped drawing unemployment the week I got my check but it's been discussed on here before and people said different things. I think you'll have to put it on the annual review. Just make it clear on the form that it was unemployment and not any other type of wages. Good luck

    thans so much for the reply. folks like you make this the best website for Vets out there period. Once i get the IU approved i will stop taking the benifit ever again. i just wanted to pick your brain a little and it also makes me feel good that another brother did what i am doing up until i get my decision. my VA doc is the chief of staff of all mental health at Tomah Wis. This is a HUGE PLACE and he wrote a letter stating i am under his care and that i will "not be able to engage in competitive employment now, or in the forseeable future due to my PTSD symptoms." how far will this go with the VA and how far will this go for SSDI? the SSDI set me up with a appt. on may 11th for a mental exam. they have the letter from my doc as well and all my records yet they want to exam me. dont know what to think. thanks for the reply and if you could reply to me when you can on this i would be so grateful. thanks again BROTHER.

    hello i see you on here giving alot of good advice. i do have issue with one of your post and maybe its me and i am wrong. i am pending IU right now with VA. i am 70% ptsd and various others at 30% and lower to give me a combined 90%. IU was filed Jan 27th 2009 and i have not worked since May 2008. my factory closed its doors on Dec 29th for good and in order to qualify for severance i took vacation on paper but never worked since May. i am due to go in for my 2nd stint in 1 year for 2 months at the residential combat ptsd ward in Tomah Wis and because the factory closed i am on unemployment. now yes in Wis like Nc it says "did you look for work?" and the answer is yes i am trying but nobody will hire me with the disabilities i have now. i am not granted IU as of yet so until i am i am not worried about UI benifits because I do not make the IU decision the VA does and until they do i will still try and look for work even though i cannot get anything i will keep trying. if the VA approves my claim i will kill UI benifits right away. lets say this for instance.....lets say i did not file for UI because of a VA pending claim and it comes back denied...NOW i am screwed by many time lines for UI benifits. i asked my CVSO at regional in Milwaukee and he told me "listen you have not been approved jack squat as of yet but once you do you CANNOT COLLECT THEM BOTH AT THE SAME TIME" which i knew already but as for claiming UI while your are pending a IU decision is not the issue. i know you and others may say WAIT...you are telling the VA you cannot work and you are telling UI you can and thats a problem. I say this...... first off i am not telling VA anything! i am putting in for consideration for IU and that is the VA'S call not mine. when they decide my claim i will keep my UI if denied or kill UI if approved.     Were on the same page. The 5th question for the North Carolina ask specifically "Were you available for work this week". I filed for unemployment all the way up until the day I got my letter saying I was 100%. If your not IU right now, I hope you are filing for unemployment, you earned your unemployment as well. The only thing I would make sure of is to stop filing if you get an IU award. Like I said in one of my other post, there talking about giving out unemployment all of 2009 for people that qualify. Guess what? Recieved a letter from state unemployment saying i qualify and to continue filing my weekly certifications. It's a chance I'm not willing to take, I'm already recieving IU, I would hate to lose it over $159 a week. So my advice, if your asking, is to continue filing for unemployment until you recieve your IU rating, and then stop. When you get your annual review your going to have to put the info from the 1099g (from the unemployment office), the amount of unemployment you collected. I've been told that as long as you don't collect after your awarded IU, you'll be fine. Good Luck if you do file a claim for IU, and if you need any help, just shoot me a message.
